New York — Weinstein Sentenced to 15 Years After Retrial Conviction

A New York judge sentenced Harvey Weinstein to 15 years in prison on Wednesday, marking the second time the 74-year-old former film producer has received a decade-and-a-half term in the same case, according to the BBC. Judge Curtis Farber imposed the sentence after a jury convicted Weinstein last year of a single count of a criminal sexual act against former assistant Miriam Haley.

Weinstein appeared in court in a wheelchair. He denied the allegations but apologized to "anyone I may have hurt by my actions," the BBC reported.

What Charge Did the New Sentence Cover?

The 15-year term stems from a single conviction: a criminal sexual act against Haley. That is narrower than Weinstein's original 2020 conviction, which also included a guilty verdict on a charge tied to actress Jessica Mann. Haley testified that Weinstein assaulted her in a bedroom at his Manhattan apartment in 2006.

Why Was Weinstein Retried After His First Conviction Was Overturned?

New York's highest court threw out the 2020 convictions in 2024, ruling Weinstein had not received a fair trial. Prosecutors retried him, and last year a jury convicted him again on the Haley count while acquitting him of forcibly performing oral sex on a third accuser, Kaja Sokola. The jury could not reach a verdict on the Mann rape charge. Manhattan District Attorney Alvin Bragg pursued a separate trial on that charge, but the jury deadlocked in May and the judge declared a mistrial, the BBC reported.

What Did Miriam Haley Tell the Court?

In a victim impact statement, Haley said the assault had a "devastating effect on my life and sense of security that may never go away." She earlier told the BBC her decision to testify came down to a simple calculation: "I just thought, I have to stand up for myself. I have to stand up for the truth."

Judge Farber addressed Weinstein directly at sentencing: "You took what you wanted by force and you have never accepted responsibility."

What Other Legal Exposure Does Weinstein Still Face?

Weinstein is separately awaiting resentencing in California, where he was convicted in 2022 of raping and sexually assaulting an actress in a hotel room in 2013. A California appeals court upheld that conviction but ordered a new sentencing hearing after finding the original judge had factored in the New York convictions that were later overturned. Weinstein's original California term was 16 years.

He is currently held in a prison ward at Bellevue Hospital in New York, where he has been treated for a series of ailments during his incarceration, according to the BBC.
